Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Kabbes Development ("we", "us", "the platform"). By creating an account, purchasing a plan, or using the builder, templates, AI features, or any other part of the service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. You are responsible for everything that happens under your account, for keeping your credentials secure, and for the accuracy of the information you provide. Notify us immediately of any unauthorized use.

2. Plans, billing & credits

  • Subscriptions renew automatically each billing period until cancelled. You authorize us and our payment processor to charge your selected payment method on each renewal.
  • Price changes take effect on your next renewal after we give reasonable notice.
  • AI credits are a consumable, usage-metered unit. They are consumed as you use AI features and are not redeemable for cash. Once consumed, credits are non-refundable.
  • Taxes, where applicable, are your responsibility and may be added at checkout.
  • Refunds and cancellations are governed by our Refund & Cancellation Policy.

3. The builder, templates & exports

You retain ownership of the original content you create. We grant you a limited, non-exclusive, non-transferable license to use the builder, any purchased template source, and exported output to build and operate your own websites.

  • You may not resell, redistribute, sublicense, or republish template source files as a competing template, kit, or stock product.
  • Exported projects are yours to deploy anywhere. We do not host your production site and are not responsible for it once exported.
  • You are responsible for ensuring your content and any third-party assets you add are properly licensed.

4. AI features (beta)

The AI builder, code conversion, and chat assistant are provided on a beta, best-effort basis. AI output may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing, testing, and validating any AI-generated code or content before relying on or publishing it. AI output is not legal, financial, security, or professional advice. AI usage consumes credits as described in Section 2.

5. Acceptable use

Your use of the platform is subject to our Acceptable Use Policy. Violations may result in suspension or termination without refund.

6. Third-party providers & deployment

The platform helps you export and deploy to third-party hosting providers (such as Vercel, Netlify, or Cloudflare) and to your own servers. Those providers, your domains, and your DNS are governed by their own terms and are solely your responsibility. We are not liable for third-party services, outages, or charges.

7. Intellectual property

The platform, its software, branding, and original template designs are owned by us or our licensors and are protected by intellectual-property laws. Except for the licenses expressly granted in these Terms, no rights are transferred to you.

8. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI output will meet your requirements.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the service is limited to the amount you paid us in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your content, your use of the service, your deployed sites, or your violation of these Terms or any law or third-party right.

11. Termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or create risk or legal exposure for us or other users. Sections that by their nature should survive termination (including IP, disclaimers, liability limits, and indemnification) survive.

12. Governing law & disputes

These Terms are governed by the laws of [your governing jurisdiction — to be set before launch], without regard to conflict-of-law rules. The exclusive venue for disputes is [your venue], unless a binding arbitration clause is added on legal review. You and we waive any right to a jury trial and to participate in a class action to the extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date and, where required, notified to you. Continued use after changes take effect constitutes acceptance.
